A Chief Magistrate Court sitting in the Federal Capital Territory (FCT), Abuja, has dismissed a criminal defamation case filed against popular Nollywood actress Elizabeth Aishat Anjorin, widely known as Lizzy Anjorin.
The ruling has once again drawn public attention to the actress’s ongoing legal controversies.
The case, identified as CR/25/20225, was instituted by Abdullahi Adebimpe Mosadoluwa, the wife of a Lagos-based property developer popularly referred to as Ibile.
Mosadoluwa had accused Lizzy Anjorin and her co-defendant, Shakira Ayobami, of criminal defamation along with other related allegations.
Delivering his judgment, Magistrate Sunday A.A. Adukwu ruled that the case lacked merit and was improperly filed before the court. According to reports by Leadership Newspapers, the magistrate upheld a preliminary objection raised by the defendants’ legal counsel, A.U.E. Ogboi, which challenged both the competence of the suit and the court’s jurisdiction to entertain it.
The court noted that the complainant failed to comply with the Administration of Criminal Justice Act (ACJA), 2015, which requires that a single criminal charge must address only one offence.
In this case, multiple allegations were merged into one complaint, rendering the filing procedurally defective.
Additionally, the magistrate pointed out that all parties involved in the dispute are residents of Lagos State, raising serious questions about the appropriateness of filing the matter in an Abuja court.
Based on these issues, the court described the suit as an abuse of legal process and subsequently struck it out.
As part of the ruling, the court ordered the complainant to pay ₦50,000 as legal costs to the defendants.
